Terms and Conditions

EFFECTIVE DATE: February 26, 2026

1. ​OVERVIEW
These Terms and Conditions ("Terms") govern participation in programs, services, and use of the website operated exclusively by LifeCert Training Solutions, LLC ("LifeCert", "Company", "we", "us", or "our"). By registering for a program, engaging in our services, or accessing our website, you agree to these Terms. For the purpose of this agreement the individual(s) agreeing to these Terms will be referred to as "Participant(s)", or "Client(s)". For the purpose of this agreement the terms "Program(s)" or "Service(s)" shall be used interchangeably. 

 

2. COURSE PAYMENT AND REGISTRATION

Full payment is due at time of registration unless otherwise agreed in writing (i.e., invoice). We accept major credit/debit cards and other payment methods listed at checkout. Invoices may also be paid via check. Checks are to be submitted to the address affixed to the invoice. 

Returned checks or failed payments are subject to a $75 administrative fee. Client agrees to contact LifeCert to resolve disputes prior to initiating any chargeback. Improper chargebacks may result in collection action and recover of associated fees, including administrative and legal costs. Late payments on invoices will incur a $75 late fee

3. CANCELLATION AND RESCHEDULING POLICY

Individual students: Cancellations made three (3) business days before the start of service will be eligible for one reschedule or account credit; no other options are available. Cancellations made within less than three (3) business days of start of service will incur a $50 transfer fee. If a transfer cannot be made an account credit may be applied; no other options are available. 

Company Cancellation: If LifeCert cancels a program or service clients may choose (i) a full refund or, (ii) transfer to another available session. 

Corporate/Onsite Delivery Clients: See terms stated in Full Service On-Site Training Agreement.

4. COURSE REQUIREMENTS

Certain courses require pre-course work or certification that must be achieved or presented prior to or at the start of service. Failure to complete prerequisites will result in dismissal without refund.

Attendance and active participation is required for our services that offer certification. Participants must arrive on time, attend the entire session, and successfully complete the required skills and criteria for certification based on the standards of the American Red Cross or Health and Safety Institute.

Participants acknowledge CPR and related trainings may require kneeling, lifting, repetitive compressions, and other physical activity. By registering, participants affirm they are physically capable of safely performing the required skills.

5. CERTIFICATION DISCLAIMER

Certification is contingent upon:

  • Successful completion of all course requirements

  • Meeting standards set by the certifying organization

While LifeCert does offer certification courses we cannot guarantee participants will passing results, employment qualification, employer acceptance of certification. Participants are to reach out to their employer to confirm if the certification they receive will be accepted. Certification issuance timelines are determined by the certifying body and states that a participant demonstrated skill competency and met the objective of course on the date of issuance.

​6. CODE OF CONDUCT

LifeCert will maintain a professional and safe learning environment. The following will result in removal for service without a refund:

  • Harassment or discrimination

  • Behavior disruptive to the learning environment

  • Refusal to follow instructor direction

  • Intoxication or impairment

  • Unsafe conduct

 

Removal does not entitle the participant to a refund or rescheduling.

 

7. ASSUMPTION OF RISK AND RELEASE OF LIABILITY

The client acknowledges that CPR, AED, First Aid, and related trainings may involve physical activity and inherent risk of injury. 

To the fullest extent permitted by law, client voluntarily assumes all risks and releases LifeCert Training Solutions, LLC, its owners, employees, instructors, contractors, and affiliates ("LifeCert Indemnitees") from liability for injury, loss, or damage arising from participation, except in cases of gross negligence or willful misconduct. If you have any health concerns, disabilities, or other medical issues that may hinder your participation you should consult with your primary care provider to determine if you are medically fit to participate.

8. LIMITATION OF LIABILITY

To the maximum extent permitted by law, LifeCert's total liability arising out of or related to any program or service shall not exceed the total amount paid by the client for the applicable program or service. Under no circumstances shall LifeCert be liable for indirect, incidental, special, or consequential damages.

9. INDEMNIFICATION

The client agrees to indemnify and hold harmless LifeCert Training Solutions, LLC, its owners, employees, instructors, contractors, and affiliates ("LifeCert Indemnitees") of (i) participants negligence or misconduct, (ii) violation of these terms, (iii) injury caused by participant to others during service. 

10. MEDIA RELEASE

LifeCert may photograph or record all or portions of the service. Participants grant permission for such unless written opt-out notice is provided prior to the course. Media will not be used in defamatory or misleading contexts. Furthermore, participants agree that the company and its affiliates may use, publish, republish and distribute photographs or recorded videos for purposes related to training services, sales, marketing, and public relations.

11. COMMUNICATION CONSENT

By registering, the client consents to receive transactional emails and SMS messages related to: (i) course confirmations, (ii) reminders, (iii) certification notifications/expiration reminders, (iv) administrative updates. Clients may opt-out of marketing communications at any time by contacting LifeCert's Support Team via email at support@lifecerttraining.com

12. FORCE MAJEURE

LifeCert shall not be liable for delays or failure to perform due to causes beyond reasonable control, including but not limited to (i) severe weather, (ii) natural disasters, (iii) government orders, (iv) power outages, (v) public health emergencies or other acts of God.

13. USE OF INDEPENDENT CONTRACTORS

Instructors providing services through LifeCert may be independent contractors and are not employees of the client.

14. DISPUTE RESOLUTION

Any dispute arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be brought exclusively in the courts located in Will County, Illinois. Client agrees to waive participation in class actions.

15. GOVERNING LAW

These Terms shall be governed by the laws of the State of Illinois. 

16. MODIFICATIONS

LifeCert reserves the right to update these Terms at any time. Continued use of services after changes constitutes acceptance.

17. SERVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

18. INTELLECTUAL PROPERTY
The service and its original content, features and functionality are and will remain the exclusive property of LifeCert Training Solutions, LLC, and its affiliates and licensors.


19. DISCLAIMER

The client's use of our service or the service of our designees is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. The service is provided without warranties of any kind, whether express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
 

These terms of conditions have been written, posted, published and reviewed before use by LifeCert. Any and all inquiries about this policy should be directly submitted to the CEO or General Manager of LifeCert.
