TERMS OF AGREEMENT
Upon registration for any LifeCert Training Solutions, LLC program or accessing the LifeCert Training Solutions, LLC website, parties are adhering to LifeCert Training Solutions, LLC terms and conditions and other applicable terms of service. Below are all of the terms and conditions that parties are adhering to once registered for a course or accessing our service.

​OVERVIEW
Please read through these Terms of Use/ Terms of Agreement/ Terms of Service/ Terms and Conditions carefully before using our website ("Service") operated exclusively by LifeCert Training Solutions, LLC ("LifeCert", "us", "we", or "our").

Your access to and use of the service is conditioned on your acceptance of and compliance with these terms. These terms apply to all visitors, users, and others who access or use our service. By accessing or registering on our service you agree to be bound to these terms. If you do not agree with any part of our terms you may not access our service or register for our programs.

​ACCOUNTS, PARTNERS, AND THIRD PARTIES
​Our service may contain links to third party websites or services that are not owned or controlled by LifeCert. 
LifeCert Training Solutions, LLC has no control over and assumes no responsibility for the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that LifeCert shall not be responsible or liable, by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.

 

When you create an account with us, or register for a program you must provide us with information that is accurate, complete and current at all times. Failure to do so constitutes a breach of the terms, which may result in immediate termination of your account or program.
 

You are responsible for safeguarding the password that you use to access the service or the service's authorized providers and for any activities or actions under your passwords, whether your password is with our service or a third party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. 

INTELLECTUAL PROPERTY
The service and its original content, features and functionality are and will remain the exclusive property of LifeCert Training Solutions, LLC and its affiliates and licensors.

PAYMENT POLICY: All major credit/debit cards and checks are accepted by LifeCert. Payment is due in full at time of registration unless otherwise stated by invoice issued through us. Any returned checks will incur a $75 fee, and any late payments on an invoice or statement will incur a $75 fee for every week payment is delayed with late payments starting after the 5 day grace period. Any late payments are subject to potential legal action which is to be reimbursed at the client's expense.

CANCELLATION AND REFUND POLICY: All programs are non-refundable and we have the sole right to cancel, postpone and or discontinue any program. If your program is canceled for any reason you will be issued a full refund for the course minus any applicable service fees as those are non-refundable.​ Participants have three business days prior to the course start date to petition for a refund and be dropped from the course. Any requests made after the three (business) day time period will be rejected, and the participant will not be eligible for a refund. Parties who commit a no-call no-show, attend a program late, are unsuccessful during the course, and or ejected for disrespectful or disruptive behavior will be ineligible for a refund; NO EXCEPTIONS.

PRECOURSE WORK AND PREREQUISITES: Majority of our programs involve precourse/e-learning work that must be completed prior to the first day of the program. If that work is not completed before the first day you will be dismissed from the course and will be ineligible for a refund.

 

Some of our programs also involve prerequisites that must be completed before a party can gain entry into the program. If a party exhausts all their attempts (2) at any of the prerequisite skills they will be dismissed from the program and will receive a 50% refund, not including the certification fee which is paid directly to the certification issuers.

INFORMATION AND DIGITAL MEDIA CONSENT AND RELEASE: By registering for a program you're granting us and our designees unlimited permission to photograph, videotape and record. You're as well allowing us and our designees permission to use, publish, republish and distribute any form of media for any purpose related to training services, sales, marketing, and public relations. A list of our agents and affiliates are made available upon written request to the Owner of LifeCert Training Solutions, LLC.

ASSUMPTION OF RISK AND WAIVER OF LIABILITY: Our programs require participation in classroom and skills sessions and parties may be required to participate in rigorous physical activities such as CPR, water rescue skills, moving a person, etc. These programs can be strenuous and there is a risk of serious bodily injury or death. If you have any health concerns, disabilities, or other medical issues that may hinder your participation you should consult with your primary care provider to determine if you are medically fit to participate.​​ Parties who register for our programs herby acknowledge the risks and hold LifeCert Training Solutions, LLC and it's indemnities harmless.  

 

FORCE MAJEURE:

Notwithstanding anything in this Agreement to the contrary, neither you nor LifeCert will be liable to the other for any loss or damage arising as a result of breach, non-performance or partial performance of its obligations under this Agreement (except for the obligation to pay money when due) due to any cause beyond its reasonable control and without its fault or negligence, including but not limited to any delay or failure caused by failure, unavailability or shortage of power, materials or supplies, flood, fire, storm, other abnormally inclement weather, act of war, terrorism, riot, act or omission of government or governmental agency, strike, work stoppage, other labor unrest, inadequate voluntary donations required for the rendering of the services, other act or omission in the process of manufacture, production or supply under the control of third parties, or any other emergency.

GOVERNING LAW: These terms shall be governed and constructed in accordance with the laws of the United States without regards to its conflicts of law provisions. Our failure to enforce any right provision of these terms will not be considered a waiver or those rights. If any provision of these terms is held to be invalid or unenforceable by a court, the remaining provisions of these terms will remain in effect. These terms constitute the entire agreement we might have between us regarding the service. 

CHANGES TO THE TERMS: We reserve the right at our sole discretion to modify or replace these terms at any time. If a revision is done the date at the bottom of this page will be changed to the date of the most recent changes. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after those revisions become effective, you agree to be bound by revised terms. If you do not agree to the new terms please stop using the service.

DISCLAIMER: Your use of our service or the service of our designees is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. The service is provided without warranties of any kind, whether express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
These terms of agreement have been written, posted, published and reviewed before use by LifeCert. Any and all inquiries about this policy should be directly submitted to the Chief Executive Officer of LifeCert Training Solutions, LLC.
